Having accepted all terms of Anna Hazare by Government of India and Anna all set to break his 4 long days fast, let’s see what he and we have achieved thru it.

So what Jana Lokpal bill actually is. Well it’s not another gimmick by any political parties or media. It’s definitely a step towards a corruption free society in India. A step against the corruptions led by our politicians.

As we all know that in almost all corruption the root belongs to some politicians from any political party. So to address these corruptions we need a committee that consists of non-political persons and who are well known in country for their honesty and excellence in different fields. This bill just addresses the same. It says that the a civic committe will establish which will be comprised of non-political persons and who are well known for their honesty in their fields. The members could be like Kiran Bedi, Anna Hazare, Nandan Nilekani etc. Common people will be able to lodge their complains directly to this committee against any kind of corruption. This committee will review the complains and according to the importance of the complains, they will bring up the issues to Government and Government will be bound to take some steps about the issues this committee raised.

Some other important features of this bill:

  1. There shall be an institution of Lokpal with ten members and headed by a Chairperson.
  2. That part of CBI which deals with cases of corruption, shall be merged with Lokpal.
  3. CVC and the entire internal vigilance set in various central government departments will be merged with Lokpal.
  4. Lokpal will be completely independent of the Government.
  5. Lokpal shall have jurisdiction over bureaucrats, politicians and judges.
  6. Lokpal shall have the powers to initiate investigations and prosecution without needing permission from any other agency.
  7. Public grievances are often linked to demands / expectations of bribery. Lokpal shall act as appellate authority and supervisory body for grievance redressal systems in all central government departments.
  8. Lokpal shall be responsible for providing protection against physical and professional victimization to whistle-blowers.
  9. Members and Chairperson in Lokpal shall be selected through a transparent and participatory process.
  10. The functioning of Lokpal shall be completely transparent to avoid it from becoming a hub of corruption.
  11. Any complaint of wrongdoing against an official of Lokpal shall be investigated and acted upon within a month through a transparent inquiry process.
  12. If charges are proved and conviction takes place, loss to the exchequer caused due to his wrongdoing shall be recovered from all those who are convicted.

This kind of system is already successfully in many countries around the world and it will benefit the citizens of India from day one.

Good work Mr. Anna Hazare, you have shown  that sitting on railway tracks, hitting people and sending them out of state does not work. Peace and peace works.

Why do women need reservation in political arena in India? India has always been a country where men have dominated the lifestyle, decision and aspirations of women. For a thousand years old civilization women are still not independent. Though many have managed to cross this barrier but I am talking about 95% women in this country who are still dependent upon male family member; be it the father, brother, husband or son.

A businessman was murdered in Ghaziabad, UP and the DGP of the District visited the victim’s family to hand over a cheque of Rs.1.50 lakhs (naturally from public money) as compensation. Why? The dead man merely happened to be a ‘dalit’!

But, what is so bizarre, disgusting and totally unconstitutional about it? Nothing at all, except that the man was murdered by his own wife and her lover!!!

Now the question is, Would the DGPs henceforth hand over similar cheques to the families of all people who get murdered in UP or is that only ‘dalit’ victims (no matter how rich) would alone be entitled to public resources? Are the non-dalits of UP no longer the citizens of India? Are they no longer entitled to protection of the constitution?

One can understand compensation being paid to victims of riots, organised caste-crimes etc, but to compensate the murderers themselves because the victim had been identified to be a dalit is a first of its kind in the world!

Long ago we had read that in certain Muslim countries, govt. compensation in case of unnatural deaths is based on the ‘religious’ identity of the victim. Many had condemned such a scheme. But is Mayawati’s above scheme any different?  

DGP visits home of Dalit murder victim 06.06.09

The DGP of UP police visited the home of a 40-year-old Dalit businessman here and presented a cheque worth Rs 1.5 lakh to his next of kin on Friday. Rajesh Kumar Tomar, a laundry house owner, was found strangled to death on agricultural land near Ator Nangla village in Sihani Gate PS area of Ghaziabad early on Thursday morning. Police solved the case within six hours of his arrest. Four persons including the wife of the deceased and her lover have been arrested.

“I am here to execute the new directives of the State Chief Minister that the DG would personally visit the spot to show the State’s concern at the death of any Dalit in the State. A cheque is being presented to the family members of the deceased,” DGP Vikram Singh said.

Rajesh Dwivedi, inspector-in-charge of Sihani Gate police station, said: “Locals spotted the body around 5 am and called us. When we interrogated the wife, Munish, she broke before and confessed that her lover killed her husband and she had been complicit in the matter. Upon her tip-off, we picked up the others and their confessional statements matched with hers. We had solved the case in six hours.”

Extremely sad situation in INDIA.

Prime Minister Manmohan Singh took oath on 22nd May 2009, along with 19 Cabinet colleagues to begin a second five-year term at the head of a multi-party government in which his Congress party is the overwhelmingly dominant partner after a sweeping win in General Elections.

He is only the second prime minister after Jawaharlal Nehru to have a second innings after a successful five-year term.

There were four new faces in the first edition of the Union Cabinet that is expected to be followed up by another expansion of the Council of Ministers in the next few days. All the others were in the outgoing Cabinet. All but two were from the Congress party.

Overseen by President Pratibha Patil, Manmohan Singh, 76, was the first to take oath at a 45-minute function at the ornate Ashoka Hall of Rashtrapati Bhavan. This is the first time she has administered the oath of office.

In the front rows of the ceremony was a sombre-looking LK Advani, who was the prime ministerial candidate of the Bharatiya Janata Party (BJP).

Also present were Congress President and ruling United Progressive Alliance (UPA) Chairperson Sonia Gandhi, Vice President Hamid Ansari, former prime minister IK Gujral and Sitaram Yechury of the CPI-M.

Among the new entrants in the Cabinet are Mamata Banerjee, the Trinamool Congress leader who trounced the communists in West Bengal, Rajasthan Congress unit President CP Joshi, Congress General Secretary M Veerappa Moily and former Karnataka chief minister SM Krishna.

The portfolios were not announced but speculation centred around two names as the next External Affairs Minister — Kamal Nath, who has been a successful Commerce and Industry Minister and who led the developing nations’ charge in the WTO negotiations; and Krishna, who was in many ways responsible for making Bangalore the country’s IT capital.

Pranab Mukherjee, who was External Affairs Minister in the last Cabinet, is widely tipped to become finance minister, a portfolio he held 25 years ago, while Chidambaram and Antony are likely to retain their respective portfolios of home and defence.

Besides Mamata Banerjee, the other non-Congress leader who found Cabinet berth was Nationalist Congress Party (NCP) chief Sharad Pawar.

Performance, experience and continuity have been the important criteria that have gone into the making of Manmohan Singh’s new Cabinet, say party insiders. The Prime Minister has already chalked out a 100-day action plan for his government.

Anand Sharma, who earlier was a minister of state for external affairs and also held independent charge of the information and broadcasting ministry after Priya Ranjan Dasmunsi was hospitalised with a stroke, was promoted to cabinet rank.

So was Bijoy Krishna Handique, who is from Assam and was the minister of state for chemicals and fertilisers and parliamentary affairs.

Heavyweight Arjun Singh has been dropped from the Cabinet, and not just because of his poor health. Some of his decisions as human resource development minister have been questioned and he has been accused of sitting over important decisions in the field of higher education, a subject close to the Prime Minister’s heart.

Arjun Singh is likely to be made a state governor.

Mamata Banerjee is likely to get railways, a portfolio she has held earlier in the cabinet of prime minister Atal Bihari Vajpayee, while Pawar is set to retain his food and agriculture portfolio.

Among the 19 who took oath were three women – Mamata Banerjee, Ambika Soni and Meira Kumar. Barring four, all the ministers took oath in English.

Joshi, who turned the fortunes around for the Congress in the Lok Sabha elections in Rajasthan by leading the praty to victory in 19 of its 25 seats, admitted he was surprised to get a cabinet berth.

After the initial breakdown of talks with the DMK on the distribution of ministerial portfolios, crisis managers in the Congress thought it would be best to go ahead with the first round of oath taking where sure-shot cabinet ministers would be included.

But political sources said the crisis got sorted out shortly before the oath-taking ceremony and the DMK is likely to get three cabinet portfolios and a few ministers of state (junior minister) positions.

Those expected to be inducted in the second round include Salman Khurshid, Jairam Ramesh, Girija Vyas and Vilas Muttemwar of the Congress, MK Azhagiri, K Kanimozhi, Dayanadhi Maran of the DMK and National Conference patron Farooq Abdullah.

Exit Poll Banned Till Last Phase of Elections

You all must have noticed that in the general elections 2009, we did not have exit polls after 1st, 2nd, 3rd and 4th phase of the elections. And we had it only after the complete election all over the India was over.

This all happened due to a ruling from the Election Commission of India that had banned the disclosure or dissemmination of results of the opinion polls during 48 hours before the end of the poll, for single-phased elections. In case of multi-phased elections, the Election Commission had put a blanket ban on the exit polls till the last round of voting is over.

The decision from the EC has come following a notification from the Supreme Court of India. In its notification the SC had said that EC has the right and authority to put a ban on the exit and opinion polls during election time and it should implement the ban.

Actually, the decision was taken by the bench of K.G. Balakrishnan, Honb’le Chief Justice of India and Justice P Sathasivam. “The Election Commission is free to frame its guidelines to regulate publication of exit polls” said the bench on a petition seeking ban on such surveys.

Finally, the Commission issued guidelines according to which, “No result of any opinion or exit poll conducted at any time shall be published, publicised or disseminated in any manner by print, electronic or any other media at any time during the period of 48 hours ending with the hour fixed for closing of poll in an election held in a single phase.” This order will be applicable to all the states and territories in which the elections are going to held in different phases.

According to the EC guidelines, electronic media includes the following:

  • Government and private radio and television and covers satellite
  • Direct-to-home
  • Terrestrial and cable channels
  • Further, dissemination includes: Publication in any newspaper
  • Magazine or periodical
  • Display on electronic media
  • Circulation by means of any pamphlet, poster, placard, handbill or any other document

The fourth round of polling on Thursday saw an impressive average turnout of 57%, second highest so far in the ongoing elections, with violence marring the voting in two seats in Rajasthan and in trouble-prone Nandigram, though West Bengal recorded a high of 75% voting.

Haryana recorded 63% polling, the turnout in Rajasthan was 50%, 65% in Punjab, 37% in Bihar, 50% in UP and 24% in Srinagar. Though voting in Srinagar was low, it was better than 18.7% and 11.93% in 2004 and 1999.

Results of several key contests were sealed in EVMs with heavyweights like Mulayam Singh Yadav, Farooq Abdullah and Lalu Prasad in the fray.

Predictably, both BJP and Congress claimed trends favoured them. Congress managers claimed the party could bag up to 35 seats in this round, widening their lead over rival BJP with gains in Rajasthan where the party is eying 15 seats and in Haryana where it is confident of retaining seven of the nine seats it won last time. It also interpreted the high turnout in West Bengal as a boost to the alliance with Trinamool and went on to claim that the Left’s tally would be restricted to just over 20 of the total 42 seats.

It is crucial for these projections to come true for Congress to take the pole position ahead of BJP.

For its part, however, the BJP which claimed to be leading Congress after the three rounds of polling, said it kept the advantage largely because of good showing by party’s alliance with Ajit Singh’s RLD in western UP. BJP hopes to get 8-9 seats in partnership with RLD. It was also satisfied with its performance in Rajasthan, claiming that it was able to restrict gains for Congress from the state which gave 21 seats to NDA five years ago.

After Thursday, only 86 seats  spread over TN (39), West Bengal (25), Punjab (9), Uttarakhand (5) and Himachal Pradesh (4)  remain to be voted for. But even as the combatants reach the final stretch of the long campaign, there is no clear light on the likely winner.

Congress needs to do some brisk batting in Tamil Nadu  which it had swept last time  because of the not-so-satisfactory reports from Andhra Pradesh, Bihar, Madhya Pradesh, Chhattisgarh, Jharkhand and Gujarat. BJP has no hopes in West Bengal and TN, but must do better in the last phase of UP, Uttarakhand and Himachal Pradesh in order to make up for the losses in Rajasthan and Punjab where its partner Akalis are on a weak wicket.

Reports suggested that SP’s performance in Thursday’s round in UP  spanning parts of Central and western UP  may have fallen short of expectations, but the party, as Mulayam Singh Yadav’s threat to get Mayawati government dismissed showed, seemed to think otherwise.

BSP which many feel has not lived up to its frontrunner billing, might pick up a few seats like Gautam Budh Nagar (Noida) while Congress was not really in the picture in this phase of voting in UP.

The violence in West Bengal grabbed attention as CPM cadres in parts of Nandigram were at the receiving end for a change with the party’s polling agents absent on many booths. Three persons were killed in Asansol, Jangipur and Uluberia. In some places, CPM voters were prevented from reaching booths till noon. There were clashes in Jangipur where foreign minister Pranab Mukherjee is contesting.

The fourth phase was critical to CPM as the Left holds a majority of 17 seats that went to polls. It is felt that apart from Tamluk, under which Nandigram falls, Left could drop a few seats in north Bengal. But it may be holding on to its seats like Purulia and Uluberia. The important factor is the voting pattern of Bengali-speaking Muslims in the rural areas who have shown some dissatisfaction with CPM.

In Rajasthan, where usually polling takes place quite peacefully, there was violence in Tonk where one person was shot dead by the police. There were reports of rigging at Dausa where Meena and Gujjars allegedly captured booths in their areas of influence. With Meena strongman Kirorilal Meena facing Qamar Chechi, a Gujjar relocated from Kashmir, the clash of the two independents has attracted considerable attention.

While Congress seemed to have an edge in Rajasthan, the difference was perhaps narrow, with BJP a few seats behind. With BJP having gone in for a last-minute surge in campaigning, the battle remains intriguingly poised. If Congress holds its own, the party will get a much-needed boost in the final phase of elections. Congress seems well placed on the four Punjab seats that have gone to polls as well with attention focused on Bathinda where Congress leader Amarinder Singh’s son Raninder Singh is pitted against chief minister Parkash Singh Badal’s daughter-in-law Harsimrat Kaur. It is felt the SAD has a very slight edge in the battle.

In Bihar, RJD leader Lalu Prasad seems to have made it with a good turnout of his supporters in Patliputra. After reports that polling in Saran, the other seat he is contesting, may not have gone his way, voting at Patliputra was crucial for him. JD(U) and BJP are set to win in Nalanda and Patna Sahib with former star Shatrughan Sinha on the latter seat.

Again there is less voting incident at Mumbai. Even not only in Mumbai it has been happening in all major cities of country. Elections are being held on very near weekends and holidays and people prefer to enjoy and spend their valuable time to some spots rather than wasting their time to voting.

Last 30th April it is evident there is only  43.8% of voting held in Mumbai who has literacy rate of 77%. It is same Mumbai who took part and stood aggressively against anti national elements and lethargic policies of govt. on 26/11 terror attacks. That time entire public of city (few were from other cities too) regardless of their caste, religion and profession stood uniformly to show their solidarity towards the attack victims. That time every one pledged to take part constantly in nation building processes.

Besides lot of efforts have been put by various govt. and non govt. organizations to make public aware regarding the voting duties and rights given by constitution nothing is being taken positively by honorable public of India. Same here (in Mumbai) all practices seem to be going in vain.

Question is, where were Mumbaikars at this time? When it comes to take part actively in democratic processes everyone seems quitting with their own excuses.

Problem is that 30th April was holiday for voting, 1st May is ‘Maharasthra Day’ so it is holiday and Sat. Sunday will be weekends. So intelligent Mumbaikars had already booked their days for nearest tourist places Mahabaleshwar, Khandala, lonawala etc.

When we will realize Voting day should not be considered as holiday? It is a precious day which comes only once in five years (for general elections) and it is our fundamental right and moral duty to be participated in that. We have largest democracy in world and elections are the biggest ‘public festival’ of this democracy.  Finally this govt., which is to be formed, will be responsible for our future state. Understand this !!

When we (youth especially) will understand if we don’t participate actively in democratic processes of country nothing would be changed. No person else will come to solve the problems. We and only we should realize our responsibility towards city and the nation and must come forward to do the needful.

Don’t we have some time to think. Don’t we have a single day to vote!!

We need mere to cast our vote at our respective places. Convince other to cast their vote for him/herself for country and for their own generations.

1,473 voters in Madhya Pradesh reject all candidates Sat, 25 Apr 2009

Bhopal, April 25 (IANS) A total of 1,473 voters in Madhya Pradesh trooped out of polling centres Thursday without voting because they did not find a suitable candidate to support, an official said Saturday.

The voters came to the polling booths, got their names registered and then left without voting for anyone in the Lok Sabha elections.

According to the State Election Commission, this was done under Section 49(0) of the Conduct of Election Rules.

The section allows a person to register his/her presence at the polling centre and then not vote for any candidate.

Such votes are recorded by the presiding officer and considered rejection of all candidates.

The highest number of such ‘votes’ were cast in the Khajuraho Lok Sabha constituency (712), which incidentally also recorded the lowest voting at 43.21 percent.

This was followed by 418 in Bhopal constituency, 189 in Chhindwara, 41 in Betul, 31 in Satna, 20 in Balaghat, 17 in Rewa, 15 in Vidisha, 14 in Shahdol, seven each in Jabalpur and Hoshangabad, four in Mandla and two in Sidhi.

I haven’t seen a better work than the below by David Bergman, a US photographer or more than this.

He prepared a Barack Obama’s inaugural address photograph using a panorama image capturing device called Gigapan created by the Carnegie Mellon university and a canon g10 camera.

This is what he has to say about it:

Wow.

I covered my first inauguration and what an inauguration it was.

Barack Obama became the 44th President of the United States in a ceremony on the west front of the U.S. Capitol Building in Washington, DC.

Before Tuesday, I had photographed five presidents and covered big events including the Olympics, the Super Bowl, and concerts like Live 8 and Live Earth.

But this one was the biggest.

It deserved a big photo.

I made a panoramic image showing the nearly two million people who watched President Obama’s inaugural address. To do so, I clamped a Gigapan Imager to the railing on the north media platform about six feet from my photo position. The Gigapan is a robotic camera mount that allows me to take multiple images and stitch them together, creating a massive image file.

My final photo is made up of 220 Canon G10 images and the file is 59,783 X 24,658 pixels or 1,474 megapixels. It took more than six and a half hours for the Gigapan software to put together all of the images on my Macbook Pro and the completed TIF file is almost 2 gigabytes.

After I blogged an article on Election Commission looking for an option of Note to vote for any candidate, I have been keeping a close eye on this issue. Here is the latest update.

The Centre has informed the Supreme Court that there was no question of amending the law to introduce a provision allowing a voter to cast a negative vote during elections.

Additional Solicitor General Amarendra Sharan, appearing before a Bench of Justices B. N. Aggrawal and G. S. Singhvi, opposed a plea to amend the law to incorporate such a provision.

Sharan asserted before the Bench that the existing system of polling was in no way violative of the Constitution, as was being alleged.

The Centre mentioned that just as a voter holds the right to vote, he or she has also the choice of refraining from voting or going to the polling booth.

Peoples Union for Civil Liberties (PUCL) had filed a PIL in 2004 seeking separate slots in electronic voting machines (EVMs) to give a voter the option of “none of the above”, if he or she does not want to vote for any of the candidates standing in an election.

Despite the Centre opposing the suggestion, the Election Commission in a separate affidavit has stated that it had written to the Union Government as early as in Dec. 12, 2001 recommending such a provision.

According to the Election Commission, it was for the Centre to make amendments to the Representation of Peoples Act for incorporating the provision, as the EC has no powers to decide such issues on its own.

Under the existing provisions of Sections 49(O) and 128 of the Representation of Peoples Act, a voter, who after coming to a polling booth if does not want to cast his vote, has to inform the presiding officer of his intention not to vote, who in turn would make an entry in the relevant rule book after taking the signature of the said voter.

According to the Peoples Union for Civil Liberties, the Section 49(O) was violative of the Constitutional provisions guranteed under Article 19 (1( (a) (Freedom of Speech and Expression) and Article 21 (Right to Liberty) and violated the secret ballot concept.

In other words, it was claimed that if the presiding officer is informed about the intention not to vote, the voter might become vulnerable to intimidation and harassment by the candidates.

Rejecting the PUCL argument, the Centre has maintained that the concept of secret ballot system was relevant only to the Presidential election involving Members of Parliament.

According to Sharan, the election of the President has to be held by means of secret ballot as per clause (3) of Article 55 of the Constitution, whereas for elections to the State Legislatures and Parliament there is no such constitutional requirement.

The Centre submitted that the National Commission to Review the Working of the Constitution had earlier examined the issue of introducing negative votes slots in EVMs but decided not to press for the same as it was not practical.

“It may be unrealistic to expect a reasonable percentage of voters to come simply to say that they do not wish to vote for any of the candidates,” the Centre said.

It said that the exercise would be expensive as a lot of effort would have to be made to motivate people to stand in queues to cast negative votes. Stating that there was no public interest involved in the petition filed by the PUCL, the Centre urged the Apex court to dismiss it.

With general general elections around the corner and increasing civil society pressure, the Election Commission has asked the Central government to allow the option of not to vote for candidate listed on the electronic voting machine (EVM).

The commission, in a reply to a RTI application of an RTI activist Subhash Chandra Aggarwal, said that the government had recently been asked to provide for negative/neutral voting by adding the option of “none of the above” in the EVMs.

Hindustan Times had, in December, run a series on a need for people to have power to recall elected representatives and allow casting of negative votes.

Civil society organisations like Association for Democratic Reforms, (ADR) which has been asking for “none of the above” to be provided in the EVMs want the government to cancel the elections, if the maximum votes are polled under this option.

“This will provide a meaning to the option,” said Anil Bhairwal, national coordinator of ADR, the organisation, which has launched a signature campaign to pressurise the government to allow “none of the above option” on EVMs.

A senior Commission official, however, clarified that if majority of the votes are polled for “none of the above” option, it will not mean that the election is nullified.

“It would mean that people opting for none of the above are abstaining from voting for the candidates listed on the EVM machine,” the official, who was not willing to be quoted, said.

The option of voting for “none of the above” is not available on the EVMs. A voter has to seek a separate form, as per section 49-O of Conduct of Election Rules, 1961, to vote for none of the candidates contesting.

“It is a very tedious task and most electoral staff are not aware of 49 O,” said Jagdeep Chokar, former dean of the Indian Institute of Management, Ahmedabad, who had used 49 O in the recently conducted elections for Delhi assembly.
